In June 2009, Siskinds LLP filed a $700 million Class Action against Timminco Limited ("Timminco"). Also named as defendants are AMG Advanced Metallurgical Group, N.V. (“AMG”), and certain of Timminco's senior officers. The class action asserts common law claims in negligent misrepresentation. In addition, the Plaintiff intends to seek leave to pursue claims under Ontario's investor protection legislation, Part XXIII.1 of the Ontario Securities Act.
It is alleged in the Statement of Claim, among other things, that the defendants misrepresented the efficacy, reliability and costs of Timminco’s process for producing solar grade silicon.
The class action is brought on behalf of all persons and entities who acquired Timminco securities from December 19, 2007 to April 20, 2009 (the "Class Period").
