Colacem Canada Inc.
On June 13, 2011, Siskinds, Desmeules s.e.n.c.r.l. filed a motion for authorization to institute a class proceeding in the Superior Court of Quebec, district of Saint-Jérôme, against Colacem Canada Inc. (“Colacem”). The intended action is brought on behalf of all natural persons who, in the past three years, have resided or operated a business in either Grenville-sur-la-Rouge OR Harrington, Quebec AND within a five (5) kilometre radius of the Colacem cement and concrete production plant, located on Kilmar Road in Grenville-sur-la-Rouge, Quebec, (“Members of the Group”).
In this action, it is alleged that the operations of Colacem have caused nuisance to its neighbours in Grenville-sur-la-Rouge and Harrington, Quebec. That nuisance has taken the form of significant dust emissions, noise, odours, dirt, pollution and excessive truck traffic to and from the Colacem plant. It is also alleged that Colacem’s operations pose health and safety risks to the Members of the Group. The action seeks to recover damages, including future damages, for nuisance and for the losses that Members of the Group have suffered as a result of the operations of Colacem. Such losses include but are not limited to property damage and diminution of property values.
