Cooling Compressors
This class action alleges that the defendants unlawfully conspired to fix, increase, and/or maintain prices at which hermetically sealed cooling compressors of less than one horsepower, not including compressors used in air conditioners (“Cooling Compressors”) were sold in Canada.
The plaintiff alleges that from at least January 1, 2004 to December 31, 2008, the defendants and their senior executives participated in illegal and secretive meetings and made agreements relating to price targets, specific price increases, market share divisions and production capacity for Cooling Compressors.
A settlement has been reached with Appliances Components Companies, S.p.A. and ACC USA LLC which is subject to court approval in Ontario and Quebec. A motion to approve the settlement will be heard by the Ontario Superior Court in the City of London on January 31, 2012 at 9:30 a.m. and the Superior Court of Quebec in the City of Quebec on March 12, 2012 at 10:00 a.m.
