The chocolate class action alleges that the Defendants unlawfully conspired to raise, maintain, fix, and/or stabilize prices at which Chocolate Products were sold in Canada. The term "Chocolate Products" refers to any and all Cadbury, Hershey, Nestle or Mars chocolate confectionary products.
Settlements have been achieved with all defendants that resolves the litigation in its entirety. Each settlement has been approved by the Ontario, British Columbia and Quebec Courts.
Distribution of Settlement Funds
The Distribution of Settlement Funds has been approved by the Ontario, British Columbia and Quebec Courts. During the approval process, the courts requested certain changes with respect to the monies allocated for indirect compensation through distributions to non-profit organizations. These changes apply to paragraphs 42 to 44 of the distribution. The approved distribution protocol is posted below.
