AIR CARGO
Background
This class action alleges that beginning on or about January 1, 2000 and continuing until on or about September 11, 2006, the defendants unlawfully conspired to fix, maintain and coordinate price increases for air cargo surcharges including fuel surcharges.
Surcharges are charged by major airlines that deliver cargo via air on behalf of customers. Surcharges are extra fees charged by airlines to their shipping customers above and beyond basic freight charges typically priced by weight or volume, with the intent of defraying certain external costs of the carriers.
Canadian Settlements
Separate settlements have been reached in Canada with:
- Deutsche Lufthansa AG, Lufthansa Cargo AG, and Swiss International Air Lines Ltd. (collectively "Lufthansa").
- Japan Airlines International Co. Ltd. (“JAL”)
- Scandinavian Airlines System (“SAS”)
- Qantas Airways Limited (“Qantas”)
- Cargolux Airline International (“Cargolux”)
- Singapore Airlines Ltd and Singapore Airlines Cargo PTE Ltd. (collectively “SQ”)
If you purchased air cargo shipping services within, to or from Canada between January 1, 2000 and September 11, 2006, your rights could be affected by one or more of the settlements. This includes air cargo shipping services purchased through freight forwarders.
Litigation is continuing in the Canadian Proceedings against: Air Canada, AC Cargo Limited Partnership, Societe Air France, Koninklijke Luchtvaart Maatschappij N.V. dba KLM, Royal Dutch Airlines, Asiana Airlines Inc., British Airways PLC, Cathay Pacific Airways Ltd., Korean Air Lines Co., Ltd., LAN Airlines S.A, LAN Cargo S.A., Atlas Air Worldwide Holdings Inc., Polar Air Cargo Inc., and Martinair Holland N.V.
Lufthansa Settlement

JAL Settlement

SAS Settlement, Qantas Settlement, Cargolux Settlement and SQ Settlement
The Canadian SAS, Qantas, Cargolux and SQ settlements are subject to court approval in Ontario, British Columbia and Quebec. A motion to approve the settlements will be heard by the Ontario Court in the City of London on October 13, 2011 at 11:00 a.m., the British Columbia court in the City of Vancouver on October 20, 2011 at 9:00 a.m. and the Superior Court of Quebec in the City of Montreal on October 19, 2011 at 2:00 p.m.
