    Yasmin/Yaz

    On September 5, 2013 Bayer’s motion for leave to appeal the certification decision was dismissed.

    In March 2010, Siskinds LLP filed a class proceeding against Bayer Inc. with respect to oral contraceptives Yasmin® and Yaz®. The claim alleges that Yasmin® and Yaz® are associated with increased risk of suffering various types of blood clots and gallbladder disease, compared to other available oral contraceptives.  The claim further alleges that the increased risk was known to Bayer Inc. and they failed to timely or adequately communicate the risk information to consumers and the medical community.
     
    On April 15, 2013, the Honourable Justice Crane of the Ontario Superior Court of Justice certified this case as a class proceeding. A copy of Justice Crane's reasons for his decision is posted below.

    DO YOU USE YASMIN OR YAZ BIRTH CONTROL PILLS?

    Please be aware: On March 10, 2010, Siskinds filed a class action lawsuit against Bayer with respect to the use of Yasmin or Yaz in Canada.
     
    Use of Yasmin and Yaz has been associated with an increased risk of developing any one or more of the following:

    • Stroke,
    • Deep vein thrombosis,
    • Pulmonary embolism,
    • Heart attack,
    • Gall bladder disease and/or removal.
     

    The Statement of Claim alleges that Bayer failed to adequately warn patients and physicians of the increased risk of health disease associated with use of Yasmin and or Yaz compared to safer oral contraceptives. 

    On January 28-30, 2013 we had a Certification Hearing, and on April 15, 2013, the Honourable Justice Crane of the Ontario Superior Court of Justice certified this case as a class proceeding. A copy of Justice Crane's reasons for his decision can be found above. Certification is the first step in a class action, this is where the court approves it to proceed as a class action as opposed to a number of individual claims. Bayer is seeking leave to appeal the certification decision, and that leave motion is scheduled to be heard on September 4, 2013.
