In August 2014, a proposed class proceeding was commenced in Ontario against Ford Motor Company and Ford Motor Company of Canada Ltd. (collectively referred to as “Ford”) relating to the MyFord Touch infotainment system and the similar systems in Lincoln vehicles, MyLincoln Touch (collectively referred to as “MyFord Touch”). The proposed class proceeding alleged that in various advertising materials, Ford represented that MyFord Touch would enhance the driving experience and provide safety features to its customers that it did not, in fact, deliver.

Siskinds is of the opinion that the proposed MyFord Touch class proceeding is no longer viable, and the representative plaintiff no longer wishes to pursue the claim against Ford. On this basis, Siskinds sought and obtained the approval of the Ontario Superior Court of Justice to dismiss the proposed class proceeding.

The limitation period for bringing any potential claim related to the issues raised in the proposed class proceeding, if there is any time left within it, will recommence on December 28, 2022. On the expiry of the limitation period, any right you may have to sue over these matters may be extinguished. Limitation periods vary across Canada.
